Terms of Service

These Terms of Service ("Terms") govern your use of crm.greenstaterestoration.com(the "Site"), the online job portal operated by Green State Restoration, Inc. ("Green State Restoration," "we," "us," or "our"), a Washington corporation and registered general contractor. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Our public marketing website, www.greenstaterestoration.com, is a separate site with its own terms and privacy policy. These Terms apply only to the Site above.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Site. By using the Site, you represent and warrant that you meet these requirements.

2. Description of Service

Green State Restoration is a property restoration contractor. We perform emergency mitigation and repair work on damaged residential and commercial property, including water damage mitigation and structural drying, fire and smoke damage cleanup, mold remediation, storm and other emergency response, contents cleaning and storage, and the reconstruction needed to put a damaged building back together.

The Site is the online portal we use to run that work. Depending on your relationship with us, it may let you:

  • View the status, schedule, and assigned crew for a job at your property
  • See photos, drying readings, scopes of work, estimates, and invoices for that job
  • Review and electronically sign work authorizations and other job documents
  • Exchange messages, documents, and photos with our team
  • Join a scheduled video call with a restoration specialist
  • Submit and manage work as an approved subcontractor or trade partner

The Site is an account-based tool for our customers, subcontractors, and staff. It is not a public marketplace, and access to job information is limited to the people connected to that job.

3. We Are a Contractor, Not a Lender

Green State Restoration does not lend money, extend credit, broker loans, or arrange financing of any kind. We do not fund repairs in exchange for repayment out of a future sale, refinance, or other proceeds, and we do not take an interest in your property in exchange for performing work. Nothing on the Site is an offer of credit, a loan, or a financial product, and nothing on the Site is investment, tax, legal, or financial advice.

You are responsible for paying for the work we perform under the terms of your signed contract, including any insurance deductible and any amounts your insurer does not cover.

4. Your Contract Controls the Work

Restoration work is performed only under a separate written agreement — a work authorization, service agreement, change order, or similar contract signed by you and by us (your "Contract"). Your Contract, together with any statutory disclosures we provide with it, governs the scope of work, the price, payment terms, warranties, lien rights, and cancellation rights that apply to your job.

These Terms govern the Site only. If anything in these Terms conflicts with your Contract, your Contract controls as to the work itself. Using the Site does not by itself create a contract for restoration services, and no scope, estimate, schedule, or message shown on the Site is a substitute for a signed Contract.

5. Estimates, Scopes, and Schedules

Estimates, scopes of work, line-item pricing, measurements, sketches, moisture and drying readings, projected completion dates, and schedules shown on the Site are working documents. They reflect conditions as understood at the time they were prepared and are subject to change as work progresses.

Restoration work routinely uncovers hidden damage once materials are opened up. A change in scope or price arising from conditions that were not visible at the time of the original estimate will be handled as a change order under your Contract. Nothing shown on the Site is a guarantee of final cost, final scope, or a completion date unless it is stated as such in a signed Contract or change order.

6. Insurance Claims

Where your job is being submitted to an insurance carrier, we may prepare documentation and estimates in industry-standard formats and correspond with your carrier, adjuster, or their representatives at your direction. We are a contractor — not a public adjuster, an insurance agent, or your legal representative — and we do not adjust claims or give legal advice about your policy.

Your insurer decides what your policy covers. We cannot guarantee that a claim will be approved, that any particular line item will be paid, or that the amount your carrier approves will equal our estimate. You remain responsible to us for the full contract amount, including your deductible, any depreciation not recovered, and any work your carrier declines to cover.

7. Emergency Work and Site Access

Mitigation is time-sensitive — untreated water damage becomes microbial growth within days — so work often begins immediately after you sign a work authorization. By authorizing emergency work you confirm that you own the property or are authorized to approve work on it, and you grant our crews and equipment access to the affected areas for the duration of the job.

Equipment we place at your property — air movers, dehumidifiers, air scrubbers, monitoring sensors — remains our property. You agree not to move, unplug, or switch off that equipment without our direction, and to tell us promptly if it stops running: interrupting a drying chamber can extend the job and increase its cost.

8. Accounts and Access

Some parts of the Site require an account or a secure link sent to you. You are responsible for keeping your login credentials and any secure links confidential, and for all activity that occurs under your account. Do not share a job link with anyone who is not entitled to see that job's information. Tell us promptly at info@greenstaterestoration.com if you believe your account or a link has been compromised.

9. Text Messages

If you provide your mobile number and consent, we send text messages about your restoration job — appointment and inspection reminders, job status updates, and secure links to join a video call with a restoration specialist. Consent to receive texts is not a condition of purchasing any goods or services from us.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or Reply HELP for help. You can also sign up at crm.greenstaterestoration.com/opt-in, or reach us by calling (425) 300-6431 or emailing info@greenstaterestoration.com. Carriers are not liable for delayed or undelivered messages. How we handle your number is described in our Privacy Policy.

10. Photos, Documents, and Electronic Signature

Documenting a loss is part of the work: we photograph and record conditions before, during, and after restoration for the job file and for your insurance claim. Photos, readings, and reports produced for your job are available to you through the Site.

You may upload content — photos, documents, notes — only if you have the right to do so, and you grant us permission to use it to perform and document your job, to support your insurance claim, and to keep the records that law and our insurers require. By signing a document electronically on the Site, you agree that your electronic signature is legally binding and has the same effect as a handwritten signature, and that we may deliver records to you electronically.

11. Acceptable Use

You agree not to:

  • Provide false, misleading, or inaccurate information
  • Access a job, account, or record you are not authorized to see
  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Scrape, crawl, or use automated means to access the Site without our written consent
  • Attempt to interfere with, compromise, or disrupt the Site or its infrastructure
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Site to transmit spam, malware, or other harmful content

12. Intellectual Property

All content on the Site — including text, graphics, logos, software, and design — is the property of Green State Restoration, Inc. or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our express written permission. This does not restrict your use of your own job records, which remain available to you.

13. Third-Party Services

The Site relies on third-party providers for hosting, data storage, email, text messaging, video calling, mapping, and similar functions, as described in our Privacy Policy. We are not responsible for the availability, accuracy, or practices of those providers, or of any third-party site we link to.

14. Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND FEATURES ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE, SCHEDULE, MEASUREMENT, OR READING DISPLAYED ON IT IS FREE OF ERROR.

This section disclaims warranties about the SITE only. It does not limit, waive, or disclaim any warranty on our restoration work, which is governed by your Contract and by applicable Washington law. The Site is not a substitute for emergency services; if you have a life-safety emergency, call 911.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN STATE RESTORATION, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED $100. This limit applies to the Site only. It does not limit our liability for the restoration work itself, which is governed by your Contract and applicable law, and it does not limit any liability that cannot be limited under Washington law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Green State Restoration, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

18. Dispute Resolution

Any dispute arising from these Terms or your use of the Site shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration administered in Snohomish County, Washington, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

This section applies to disputes about the Site. Disputes about the restoration work are resolved as your Contract provides. Nothing here waives any right you have under Washington law to make a claim against a registered contractor's bond, or to use any dispute process that law makes available to you.

19. Modifications

We may modify these Terms at any time by posting the revised Terms on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

20. Termination

We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice. Upon termination, your right to use the Site ceases immediately; ending Site access does not by itself end your Contract or any obligation under it. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
